Special Treatments

Under the Local Government (Miscellaneous Provisions) Act 1982 (as amended) a person shall not carry on the business of:

• Tattooing 
• Semi permanent skin colouring [ including micropigmentation]
• Cosmetic piercing [including ear piercing]
• Electrolysis

unless he is registered by the local authority, at the premises where he desires to carry on his business.

A person shall not carry on the practice of acupuncture unless he is registered at premises also registered.

Registration is not required if the business is carried on by or under the supervision of a person who is registered as a medical practitioner and [with regards to acupuncture only, a dentist.

The purpose of registration is to ensure that essential health, safety and hygiene standards are maintained in any premises where these activities are carried out.

Applicants must complete a registration form and pay a fee which covers the cost of administration and inspection of the business. Applicants must comply with byelaws where these are in force.

Registration applies in the same way to so-called ‘guest’ artists who attend trade fairs and similar events in our area. Where the business of carrying out cosmetic piercing, tattooing, semi-permanent skin-colouring or electrolysis or the practice of acupuncture occurs, registration is required. 

Fee structure:

£294 per application

An extra £50 for each additional treatment applied for at the same time. Additional treatments applied for later will incur the full fee of £294.

Tattoo Hygiene Rating Scheme

What is it?

The Tattoo Hygiene Rating Scheme (THRS) is a voluntary scheme aimed at improving the standards of tattooists and semi-permanent makeup artists; allowing the public to chose a practitioner that meets high standards of hygiene.

The THRS does not replace the legal requirement to register under the Local Government (Miscellaneous Provisions) Act 1982.

Each tattooist will still need to be registered.

The THRS, which was piloted across Welsh authorities, is now being taken up by local authorities around the UK and was launched Kent and Medway wide on 1 June 2015. Research, by the Chartered Institute of Environmental Health, shows that 93% of customers considering having a tattoo would be influenced by a rating scheme.

Tattooists surveyed as part of this research felt hygiene ratings would give recognition to well-run studios while driving out unregistered and unsafe practitioners who often operate from home, known in the trade as ‘Scratchers’.

Trade bodies such as the British Tattoo Artists Federation (BTAF) and the Tattoo and Piercing Union (TPIU) have expressed support for introducing such a rating scheme.

How does it work?

Participation in this voluntary scheme is by application and is completely free of charge. All participating premises and local authorities will be bound by the ‘Rules of the Scheme’. The Rating Schedule will tell you what standards you need to achieve in each rating.

Tattooists and semi-permanent make up artists will be assessed using a set inspection proforma.

We will aim to re-rate premises every 12 months from the date of their initial rating visit. Due to potential demand initial rating visits will be carried out in order of receipt of applications.

Premises will be rated one to four, one being the lowest and four being the highest.
