Public Spaces Protection Orders (PSPO)

Introduced under the Anti-Social Behaviour, Crime and Policing Act 2014, Public Spaces Protection Orders (PSPO) are intended to replace the current Designated Public Place Orders (DPPO), the Dog Control Orders (DCO) and Gating Orders.

If there is evidence of behaviour in a public space which is having or is likely to have a detrimental effect on the quality of life of the community and the behaviour is persistent/continuing and unreasonable, a Public Space Protection Order (PSPO) can be introduced by the Council to include restrictions on specific behaviour and/or requirements for people to abide by when on the public space in question. All anti-social behaviour can be considered for a PSPO and not just dog or alcohol issues.

Failure to comply with a PSPO enables authorised enforcement officers to issue fixed penalty notices of up to £100 or the person could find themselves prosecuted. A breach is a criminal offence and there is a maximum penalty of a £1,000.

Any current DPPO or DCO which have been in place since October 2014 converted to become PSPO's on 20th October 2017 and will remain in place for a period of 3 years unless amended or reviewed in this time period.

Swale may look to review current orders and consider amending conditions before 20 October 2020.
